Question:

If an Illegal Immigrant is under the age of 18..?

and abandoned by his parents, who left back to Mexico, what would happen to him if the Immigration found him? If he talked to a lawyer, is there any chance he would be granted amnesty since he is underage? If so, what steps would we have to take to make this happen?

  1. Illegal aliens have no way whatsoever to get "legalized."  Those brought in as children have only one chance to make things right: return to their own country voluntarily before their 18th birthday.  If they do so, their parents' illegal actions will not be held against the child, and the child will be eligible to apply for immigration or visas if they otherwise meet all requirements.  If the child does not return to their own country, then they are making the decision as an adult to remain illegally, and thus their parents' acts are irrelevant, and they are subject to arrest, detention, deportation and bar to re-entry.  

    Since the parents went home, they should have taken their child.  He needs to return home immediately if he ever wants a chance to come legally.  Getting a lawyer might tie things up for a while, but then he would lose his chance to return home voluntarily and be "forgiven" for his parents' acts.  He'd end up deported and barred from re-entry.


  2. He should go back to his own country before he is 18 1/2 years old and then come back legally.  If he does that, there will not be a ten year ban on him.  

    Granted amnesty?  No.  You can't make legal out of illegal actions.

  3. If he was born here, he is a citizen, if not he needs to go back to Mexico.

  4. If he was born in Mexico, he needs to go back to Mexico ASAP.

    If he was born in the United States, he is a U.S. citizen and  child protective services in his state need to be contacted.

  8. You should be asking their parents because if they get deported they should take their children with them and that will make them responsible. If they leave them behind, then they are not too responsible and they shouldn't be granted legal status in our country.
