  1. Check with an attorney, but once a bankruptcy is filed, all collection activity on any debt must cease... including a lawsuit.


  2. if you have been summoned (or served) and the court date is not here yet, and no judgment has been entered yet, check with your lawyer about getting an order to avoid judgment or order to vacate judgment. It may not work, but it's something to look into.

  3. If you are being sued, than no, it cannot be included in a bankruptcy.

  4. I dont think you can include that into bankruptcy, if it is over $8,000 you can enroll it into a debt settlement program. Which will usually knock it down a little more than half, and if they are reliable they will give you a device to hook to your phone so if the collection agents call for that account  it automatically goes to their lawyers.  The payments will go down as much as 75%. It worked for me, and kept me out of bankruptcy all together. The company I used was www.mydebt101.com They are certified and in six months when I am done with the program it will show as paid which is better for the credit bureaus. Good Luck. P.S. Be careful with your bankruptcy, some attorneys charge as much as $5000 and if you file chapter 13 they can come to your house and auction anything the court feels is "unneccessary".
