If an illegal immigrant marries a US Citizen, is the process faster to file for their permanent residence?

I would like to know if an illegal immigrant gets married to a US Citizen, will that person be able to get her green card quicker? Is the process faster since a spouse is filing?

  1. yes and no, depends on the way the illegal enter to the country. If it came with a visa and let it expire here is fine but if cross the border on any other way then you will need a law that is not in force since 2001 and had no chance to revive right now, if the marriage is REAL it's o.k but if is just for papers, be carefully immigration is checking pretty much everything, I personally know 2 couples that did it the wrong way and were send back to their country. Hope this helps

  3. Nothing is quicker or faster or easier in immigration processing with USCIS. In addition, the illegal person, if s/he doesn't have any status in US, has to go back to the country and get interview to finalize green card process. If that person is illegal, there is no status to adjust from.  

  4. If your spouse had at one point some visa that allowed her into the country, but has now expired, you can file a I-485 Adjust to Permanent resident petition, and you can explain how your marriage is legit, and you want to live together.  If not, it will be very difficult.  

    As for quicker - it will certainly be quicker than waiting for other types of visa, I think.

  5. hi, all US citizens file their spouse are the most fastest, their immigration visa is immediate.  that means, when US CIS approves their application, they will get the greencard soon.  however the illegal immigrant should wait in his/her country.
