Does the fully covered drivers insurance sue the non-insured driver?

  1. They first attempt to recovery what they paid out directly from the at fault party.  If the at fault party fails to cooperate, then yes, they will file suit.  It does not mean they will be guaranteed any recovery.   Most of the time the insurance company will agree to set up an affordable payment plan with the at fault party.
