If both parents are african and their child is born in uk would that child be british?

  1. miss_w17 - why the automatic belief that a child born to parents from an African country would be black?

    and why the need to specify that they would be "BLACK BRITISH"?  is British not just British these days?  

    What makes you think the rules and regulations applied to them as British Citizens would different to the "white British"?

    do you think next time I fill out a form I should put "WHITE AFRICAN" for people like you who a) don't seem to think I exist and b) feel the need to mark the difference.

    As for the question:

    Starsky has got it bang on the money - as long as the parents are residing here then the child could claim British Citizenship (not black British or white British but just plain old British)


  2. The child would only be British, or English, in the sense of citizenship.

    The child's heritage will always be African.

  3. The child will have a British birth certificate so the child will be British, however due to his parents being non British the child will not automatically be a British Citizen nor gain a British passport

    Like if two Asians had a child born in the UK the child would be Brit-Asian

    In answer to your question, the child would have British citizenship, and may be able to apply for dual citizenship depending on which of the FIFTY TWO countries in Africa the parents are from.

    My husband and I are both Australian, but our child will be born in england. That will make the child british, australian, and if it wants a polish passport it can have one of those too!

    A person is a British citizen otherwise than by descent if he/she was:

    born in the United Kingdom after 1 January 1983 and one or both of his/her parents are British citizens, or were settled in the United Kingdom at the time of the birth; or

    adopted in the United Kingdom and one or both parents are British citizens.

    When you fill out forms, and they ask you what nationality you are, You have choices like "White, British & Asian, British."

    So yeah.

    Obviously there will be other things that are different from a white british person, like passport and immigration and things, but yeah, BLACK BRITISH. :)

  11. Are the parents landed immigrants?  Do they live in the UK?  What citizenship do they hold presently?  The child's citizenship depends heavily on all of those factors.

  17. who ever mentioned about the change in the law is right - a child born to foreign parents would have a british birthcertificate but not necessarily british citizenship.  they've changed the laws because so many people were using this to claim citzenship.  Now a minor can only claim citzenship through its parents (who in this case are both African), or they can apply once resident in a country for some years (I think it's 3 for the UK & Ireland) and having been born there.  But no, it's not automatic anymore that because you were born somewhere you can claim citzenship there.

  18. After 1985 or so, children born in the UK were no longer granted British citizenship. So no.

  19. It depends on African law. I'm American, so no matter where in the world I gave birth, my child would have USA citizenship (with the possibility or dual citizenship with USA and that country). If Africa has that policy, then I'd guess the child's primary citizenship would be Africa, unless one or both parents had gained Bristish citizenship.
