If contract has wrong info can we back out of car?

I thought my husband was smart enough to know how to deal with buying a car so I let him go and purchase a certified used car on his own (I'm always working). Well he made a lot of mistakes in the process but what I noticed is that in the contract they put the car at 10,000 miles less than what it really has. Its only day two, so are we obligated to the contract since it has the wrong miles? Can we get out of the car since it has the wrong number? The bank hasn't officially approved us either.

  1. You sound like a real pleasure to be married to.

    Of course you can get out of the deal. The contract is wrong and the bank hasn't approved you yet. There are still final papers to sign.

    Since you are so smart, I think you should just do the whole thing next time even though you are apparently working 12 hours per day 6 days per week.


  2. You are not obligated to purchase the car.Point it out to the salesperson. It may have beenlowered. to help get the loan.

  3. Although you may not get out of this contract, the milage issue needs to be corrected.

    If the miles were reported recently and your milage now shows up as less, there may be a warranty issue.

    Dmv will also see the discrepancy and reject the sale. It will look as if the odo was turned back.

    At the very least, the contract will have to be rewritten and the milage changed. The DMV paperwork would also need to be changed. Please point this out to the dealership and save yourself a future problem.

  4. some states have a 30 day policy that you have 30 days to back out of contract. Could also be that they lowered miles so the bank would give the loan. sometimes banks say no on the loan due to the car alone and nothing to do with your credit.  Definately shady would get out if they lowered miles on purpose, makes me think what else is wrong with car. Especially since its 'certified'.

  5. It is possible to get out of the contract, but it won't be easy. The salesman will do EVERYTHING in his power to keep you in that car. He has invested a lot of time and energy into this sale. If you back out, you are taking money out of his pocket. I'm sorry, but it's buyer beware. As a consumer, you should not sign ANYTHING unless you know what you are doing.

  6. Seems like you have a case of false advertising.  If you are in the u.k then contact your local trading standards office.  It seems that they are breaking the sales act.
