If deceased persons name is still listed as property owner does that mean property has not been foreclosed on?

If the mortgage company foreclosed on a property, would the mortgage company's name be in the "owner" on the property records?

  1. It may simply be a matter of sloppy record keeping or a lag in updating the records.  I wouldn't consider it the final word on the legal disposition of the property.


  2. Depends on what stage of the foreclosure you're at when they die.  Normally all legal proceedings come to a screeching halt when someone passes away because their assets are now part of a probate process.  If the deed is still in their name, then its still theirs.
