If employer appeals workmans comp decision do I still collect?

I finally won my workmans comp after a year and a half! the judge totally ruled in my favor but of course my employer is appealing the decision. They were ordered to pay, now do I still get paid while they are appealing since this is going to take forever? I was told they have to start the checks but they also owe me for a year and a half back pay plus interest and I have past due and ongoing medical bills. Now what happens? The appeal won't be til October. Will I start getting checks and if I do what happens if for some reason I lose the appeal. Thanks!

  1. You should start recieving your compensation checks soon, and should continue to recieve them until the appeal is resolved.

    If the appeal ends in the favor of your employer, however, you may be ordered to repay any settlements/money paid to you to your employer by the judge.

    You should definitely get a Worker's Comp Lawyer. Most of them will take your case in a way that if u lose, u pay nothing, and if u win, they take an (albeit) large cut of ur winnings.


  2. You should contact the government agency that oversees workers comp law in your state for the definitive answer.  Workers comp, like other employment laws vary from state to state and are administered differently.
