If i am on an F-1 visa, can i get my fiance?

I am on an F-1 student visa, the father of my child is in the Philippines and i want to know if there's a possibility that i can petition him, and if yes, how long will it be.

  1. No, you can't petition him under any circumstances for now because you are neither a US citizen or a legal permanent resident. Only citizens can petition fiances in any case. If you did get a green card, it would take 5 years for a petition that you then filed to become valid for use. If you were married, he could at least apply for an F2 visa. However, there's no guarantee he'd get it. Plus, before he could apply you would have to talk to your university and get him placed on your I-20. you'd also have to show how you were going to support him in the US, based on estimated expenses provided by your schoool, because as an F2 visa holder, he's not allowed to work.

    Edit: on your other question. USCIS does not issue visas, but they do deal with your change of status from B to F in the US.  As long as you're in the US, you fall under the responsibility of USCIS, and as long as you're a student, you can remain in student or F status. However, once you leave the US, you must have a valid visa in the proper classification to return. So, if you have a valid B visa, that won't allow you to return to the US to go to school. You must have a valid F visa in your passport to do that. So, be careful you don't accidently mess yourself up if you go back to the Philippines.


  2. he has to be your husband if you want him to join you here in the US. also, he will not be able to work while he is here. so you need to be able to show that you can support the two of you... or three of you if you're also bringing your kid.
