i dont think so.. i bought one and mine lights up for the amount of time its set to and then it goes back to dark

While it's charging, on or off, the backlight will stay off if you don't touch the click wheel. If you want it to stay on, on your iPod menu, go to Settings > Backlight > All the time (or something like that.)
