  1. It won't be criminally illegal, however, you will be violating the Mac OS X terms of use, and Apple can sue you if they wanted to. Not that they necessarily will want to go to the expense of suing just one person.


  2. Just reformat the drive and you're fine.

    If it has OSX on it, it needs to have the original CD/DVD of that OSX with it for it to be a legally licensed OS.
