If i got something notary can i get it undone and how ?

i gave my mom and dad legal guardianship of my son while I was unable to provide for him. Can it be undone without hassle?

  1. If they are not opposed to it, you simply need to contact a family law attorney to file a petition for you in your local family court.  Since you said "notary", does that mean you simply notarized an agreement and it was never filed with any court?  If that's the situation, and your parents are ok with it, ask an attorney to draw up a simple agreement and you're good to go.  

    If they are gearing up for a fight, ohhhh, expensive, time consuming, nasty, all of the above.  I hope that's not the case for you.

  2. Are you able to provide for him now?  If so, get a family law attorney and have the courts declare you the legal guardian.

  3. A notarization is merely that an impartial party verified your identity and can testify in Court that you signed the document...there is no way to "un do" it.

    As for guardianship, if your parents are in agreement with returning your son to you it would be getting an attorney and filing the necessary documents and it would be over.  

    If your parents do not agree, you will need to hire an attorney and be able to prove you are stable and now able to provide a home for him and then it will be up to the Judge to decide and could take months, if not years, depending on how much your parents fight you over the matter.
