Question:

If i have never travelled to the U.S and have been pardoned can i travel to the u.s?

I have been pardoned,and have never been to the U.S.My question is before i was pardoned my employer asked us to fill out a form for the U.S embassy to work on their grounds as a gardener[in case we were required to go,as they are a client of ours].I said on the form that i didn't have a record.I have never been asked to work at the embassy.I'm not sure if they checked me or not.My question is, would the U.S embassy have downloaded my record and even though i have now been pardoned, and never been to the U.S would my record show up when i try and cross the border?

  1. You were pardoned from what? I don't know  what are the description of criminal status in your country but if the incident has occurred in your country that would be determined by your government and not the U.S. embassy unless the incident happened in the grounds of the U.S. embassy.

    If your employer asked you to fill out and sign a form certifying that you haven't committed any crime(hypothetically speaking) this is an act of fraud to U.S. government and you can be an accessory to it as well.

    Weigh the matter very carefully for at the end you might just pay the part for a high price.


  2. US may not allow you to enter. They want persons with clean record.

  3. (Assuming this is a Canadian Pardon you received). The only way to really know if the US border has your record is to attend at the border and enter the country. If they do have your record and you are refused entry you will have to apply for a US Entry Waiver I-192. If they do not have your record you will be free to enter. Right now you can answer the question "do you have a criminal record" as "no" since you have a pardon, and therefore no criminal record. There is no way to know 1) if the embassy downloaded your record, or 2) if when they did download it it goes into the same database that the US border protection services maintains.

  4. if you are pardoned you do not have record only way you could not come here is with felony or murder charges with your name if not come over.
