  1. This is very serious.  It is a guarantee that this will come back to you one day, like when you apply for life insurance or have a lawsuit against somebody.  I would write the doctor a letter requesting that he amend his report and explain what is wrong with the report.

  2. You can always sue somebody.  The question is, can you be awarded damages.  Will what they wrote in your records cause trouble for you later down the road.  For example, if they mistakenly diagnosed you with a condition that you do not have and this will cause trouble with your insurance provider, assuming that the doctor cannot correct matters with a simple phone call.  Did the false information cause or potentially cause health problems for you or your baby?  In order to win a lawsuit, you usually have to prove that actual damages were inflicted on you due to the actions of the doctor.  If his or her actions could have had detrimental consequences, but didn't because you caught the mistake, it is more of a matter to be reported to the medical board.

  3. Since you have given us no idea what you mean, the best we can say is "maybe?"

Unless the doctor is the father, though, I fail to see what your pregnancy has to do with anything.

  4. If no harm was done to either you or the fetus, no.

  5. Good luck finding a doctor after word gets around that you sued your last doctor. Your current doc will probably drop you like a hot potato.

You won't get anywhere unless you can prove he/she caused you harm or some sort of disability

  6. No, because you should know that pregnancy tests can produce a false negative reading.

*pregnant* and doctors can't be sued because you got pregnant.

Edit: You might be closer to 33 weeks or so.  Or maybe you are a bit further along than you thought.  I'm thinking if the meds haven't hurt the child, you probably won't win your case.

Don't you just love how people call your baby a "fetus"?  Makes me want to barf.

  7. A civil suit can't be won unless you can show proof that there is measurable harm, usually financial, resulting from the other party's actions.

Did the misinformation on your chart cause you to have, for example, additional medical tests which you had to pay for? Were you needlessly hospitalized? Did you lose a baby? Did the lies your doctor told you cause you direct financial harm, such as being fired from your job or dropped from its insurance plan?

Mistakes happen in every field, and unless you've got evidence of harm which can be compensated--by a big fat check--the best recourse is probably the insistence that they correct your medical records.

  8. You have the right to sue just about anyone you want. You might not have a case, and you might lose, but you can sue.
