If i join the military will i lose custody of my son? ?

i just posted a question a few minutes ago. i guess i didnt explain clearly enough. i have a 3 year old son from a previous relationship. i am now remarried. i have 50/50 custody of him. if i join the marines can my current wife honor the custody agreement? or do i lose custody of him?

  1. As I stated in the previous question it is up to the court system if you are allowed to retain 50/50 custody. If your custody isn't determined by the court system you better talk to a lawyer before you consider joining to find out what your options are.   When you join the military you can be stationed anywhere in the world.  you could get OCONUS orders to Japan that are unaccompanied.  If your ex decides that she doesn't want to have the child go to your wife then she might be able to have that decision honored by the court system.  Then again your wife may not have any problems.  But if you do move out of state you may loose your 50/50 custody you may instead only get him in summer, certain amount of weeks, etc...


  2. Real sticky situation here. It should be discussed with an attorney. Your sons Mother could be agreeable now, but change her mind after you leave and get full custody. I would guess that the court papers state that YOU have 50/50 custody, not your new wife.

  3. IF only people put as much effort into trying to make a marraige work as they do in worrying about what might happen if it doesn't, they wouldn't have these kind of problems.
