If i post bail and the ins deports?

if i post bail and the INS picks him up and deports him

will i get my bail money back or will they consider that jumping bail therefore i will not get my money back.

  1. Just let him be deported.  If he doesn't belong in this country then he deserves to be locked up till he's deported.

Usually, once you post bail to a bondsman you don't get any money back.  If you posted the bond with the registry of the court, then you may get it back.  My experience with INS situations is that as long as you maintain official proof that the defendant was deported and is unable to return to face charges, that the surety (bail bondsman) is exonerated from having to pay the cost for the defendant failing to appear in court.  Here because the defendant was deported and you have proof of the deportation, there is no legal way that you can produce the defendant to the court appearance.  When a defendant fails to appear, the bond is declared forfeited.  My advice is that you stay away from this legal nightmare.  On the other hand if you don't post bond, then defendant will actually have to face the charges he's accused of.    

  3. You're going to have a hard time getting your money back on the bail.

  4. If the INS ships him home before the trial , then it definitely is not jumping bail because a division of our government kept him from appearing and not him , so you should get you money back . I would however suggest that you not wait on it to appear quickly .
