I can assure you that if you leave/walk out of the marital home you WILL NOT lose any of your entitlements.  The share of marital assets and liabilities are usually agreed on a percentage basis taking into account what each party bought into the marriage (eg. homes, investments, shares, money etc), what has been accumulated throughout the marriage and what each party has contributed to the marriage, not just financially but physically.  If there are children involved, then that usually goes in the wife's favour as usually it is the wife who has raised the children etc.  Hope this helps you a bit.  If you and your husband can agree on division of property, money etc and you don't want to have lawyers involved, you can always go on to the Family Court website and download the necessary forms for Consent Orders which you and your husband sign and file with the Court.  It would be wise though to contact a lawyer to at least give you advice on what percentage division they believe you would be entitled to.  Good luck!

  3. Go to a lawyer file for the divorce and state what it is you are asking for in the petition. Then leave the house. Cover your a** first. Make sure everything you ask for is in the petition for divorce before you leave.
