If I was arrested and not convicted, can i answer "no" to N400 application(apply for citizenship) on the following question "have you ever been arrested"?. I have already been saying "no" to this questions when i go to job interview. Because I always think I was innocent, why do i have to bring this up and explain every time when people ask me about it. I am always very depressed because of the occurance of this matter.

  1. yes, of course you can.

  2. No..

  3. Of course you have to say yes ,and explain to the officer what was the problem ,the worst thing that you can do is lie to the officer ,because if there is a report and they catch you ,they can denied your application, remember that you will have to prove that you are a honest people that deserve to be a USA citizen ,,,,,,

  4. I think the question is specific because it's looking into your behavior. I would suggest you tell the truth because it would be a shame if that was the reason you were denied. If they as why you said "no" before, I would think the reason you gave here would be sufficient. As far as job applications go they usually say have you ever been convicted so there isn't any reason to have to tell anyone. It's always better to tell the truth on applications because, in the future, if something came up there wouldn't be any concern of whether you lied. Bottom line is they are looking at your behavior as an adult.

  5. You will have to say yes.  Even though you were not convicted, there is a report of your arrest on file.

  6. IF YOU WEREN'T CONVICTED DON'T WORRY.

  7. If you were arrested, then put that you were arrested.  you should be given the chance to explain this.  If  you put "no"  then you have made a false declaration and your application may be rejected if they find out.  Honesty is the best policy.

  8. Okay... it's really a matter of language.

If the question is "Have you ever been convicted of a felony?" the answer is "No" ... because you haven't been.

When the federal government asks you a question.. they're asking for specific information... and in this case, they want to know.. and have the RIGHT to know... if you've ever been arrested.  They will follow up on it, and you'll have to explain it to them.... but you need to be honest... or your application for citizenship will very likely be denied.

Of COURSE you have to tell the truth... an arrest is not a conviction...and they worded their question purposefully.

  9. I think you better read the question very carefully.  What were you arrested for?  Was it a felony or misdemeanor?  This is a Federal government form and prior to citizenship, they WILL run your rap sheet.  Arrests do appear on rap sheets.  Unlike private job interviews, arrests are not available to the general public.
