If i was in a car accident that didn't involve another car and left the seen will i be prosecuted?

if i was in a car wreck and didnt' hit anyone else and left the seen would i be prosecuted

  1. I did this in Texas, the police contacted me and when I finally went to the police station, they said if i did over 1 or 2 hundred dollars of damage to my  own car that it must be reported. I did leave my license plate @ the scene. Nothing bad happened however.

  7. No. Not as long as you didn't do any other property damage.

  8. If you damaged any property, people or vehicles, you are legally obliged to stop for sufficient time to leave your details. If you do not do so, but you report the accident to the police within 24 hours, you are legally okay. If you do not report the accident and a witness has seen it happen, or there is evidence such as CCTV footage, and the other party goes to the police, you can be found guilty of failing to report an accident. You would get your licence endorsed with penalty points, a fine, and they could even give you up to 6 months in prison.

    If you caused no damage to anyone or anything other than your own property, then it is not a hit and run and you have no obligation to file a report at all. Who would file the Hit and Run against you anyway and who would prosecute you, Yourself ? No of course not.

    The legal concept of liability does not provide that one can be liable to ones own self, that would just be crazy.

    It is not illegal to leave a scene where no injury or damage to others has occurred.

    If you did however cause damage to the person or property of another then it is still a "Hit and Run" and yes you could be prosecuted if caught.

    A true example

    I ran over a rather large Rock once, It was an accident, I didn't see the rock in time to avoid it. The underside of my car was dented in 2 places. after some moments and a few words of anger over that rock while negotiating it out from underneath my car, I then moved the rock into a grassy area away from the road for the safety of other drivers. I then left the scene and continued home. I did not file a report, there was no need for one. The rock wasn't insured.  The rock can't  hold me liable for injury and it can't sue me or prosecute me. I told that Rock if it even tried, I'd ground it into gravel. next time :)
