If i was on welfare,can the state take the death benefits from my life insurance policy when i die?

  1. They cannot take death benefits from a life policy; that goes directly to the beneficiary. However, if you have a policy that has a cash value greater than $1500 they can require that you cash it in while you're still alive and use the cash value for your health care. This usually only happens if you are receiving long term care from the state. I've never heard of it being taken for general health care but it is possible.


  2. Assuming you're in the U.S., no.  The death benefit goes directly to the named beneficiary(ies).

  3. Only if the named beneficiary is your estate - then it becomes "your assets" which must pay off your liabilities, before your heirs can get any of it.

    Otherwise, it goes to the named beneficiary - and is outside of your estate.
