most likely, yes. If you haven't secured permission, & they have registered their work, then yes, it would. Beyond that, it's just kind of rude to profit off their work without at least offering them something for their labor.  At the very least, they should be credited for it in some way.

You would be violating the law, if you really want to sample something to make money, you must first get permission from the original composer of the item.
