  1. I would have to say yes.  I think overtime is based per week.. but i could be wrong because I've only worked at jobs that pay weekly.

Under the Fair Labor Standards Act, federal law requires the paying of overtime for any hours worked beyond 40 in one week.  The week does not necessarily run from Sunday to Saturday, but it must be consistent for all and not be changed.  Assuming that the hours you listed were all during the same week as designated by the employer, under the FLSA, you are entitled to 8 hours of overtime pay for te second week, assuming you are not an exempt employee.

  3. When you went over 40 hours, you hit overtime.  Whether or not they will pay you is another matter. /

  4. Yes, you have 8 hours in the second week.  

  5. That depends on the policy in your company.  Some say you get overtime above 40 hours in a week, some say you get overtime only if you exceed the regular hours in a pay period. Even if your local laws support weekly overtime, your company policy may override it.  I would ask the person who calculates your payroll hours and get a copy of the payroll policies for your company.  Good luck!
