  1. Yes.  If the conditions of your probation include no xanax (or other meds), then you're in violation of your probation even if it's prescribed.


  2. Ask the PO where he got his medical degree. I got one of those too. Do not worry. They wanted me to stop Xanax because the outpatient drug clinic would not let me attend if I was on it. They cannot dictate to you your medications.

    a buddy of mine got a hand operation while on probation and the Dr. gave him opiate based pain-killers, the PO tossed him back in jail for 1 month and he couldn't do a thing about it.

    The PO claimed all pain medication should be administered while the Dr. is present...no 'walk away' prescriptions.

  7. A doctor over rules a probation officer.  But you need to bring in the prescription, not just have the drugs.

  8. Hello Pat, I work with most probation officers in my county. This is very good question. Do not take this in stone, but I believe if you were already given the prescription by your Doctor before you were placed on probation. All you would need to do is have him/her to type out a statement that you are on this medication. Now, by doing this I hope you understand your probation officer will probably have you tested more often to check for any other drugs. A judge will half to sign an order for the extra testing, but he/she want have a problem signing one knowing you are taking Xanax. The judge will also review your case to see the reason you were placed on probation. If he/she feels that Xanax will complicate the problem, he/she will advise you to request for your Doctor to prescribe an alternate drug. Now, what that will be I have no clue! There may not even be another drug. You may end up having to speak with an attorney about this. Good Luck !

If the medication is prescribed by a legit doctor then you are allowed to take it.  You need to be open with your probation officer about it, and you may need to sign an authorization form for the probation officer to have access to medical records, for the purposes of confirming the prescription, what it's for, and how often and when you are taking it.  If the PO has a random drug test done on you he can also have it checked as to how much is in your system to see if it matches the prescription to make sure you are not abusing it.
