I know most want a third of the settlement, but is there a particular/average amount they're looking for?

  1. Yes.  A third.

If a case involves the loss of a car and the total judgment is $18,000, the attorney's portion would be $6,000.

If the case is complex and involves the client's loss of sight, the judgment may be $600,000, with the attorney's portion being $200,000.

Usually, the judgment will include the principle amount, plus court costs, plus attorney fees, plus interest.

Example: A judgment for $50,000, plus $300 court costs, plus $4,800 attorney fees, plus 8% post-judgment interest.  It remains unpaid for a couple of years.  Finally, the attorney finds the defendant's assets and gets a writ executed, collecting $30,000.  He would take $10,000 and keep looking for other assets until the rest is paid or until he dies or tires of looking.

  2. one lakh

  3. Enough to make it worth their while to file, go to court, petition witnesses if necessary.
