If marijuana was found in the car...

If a passenger in a vehicle has luggage in the trunk of a vehicle that contains contraband (lets say marijuana in a very small amount), a police officer was to find it, and the passenger was to claim the marijuana, would the driver/owner of the motor vehicle be responsible?

  3. No, only the person who admitted it. If nobody admits it, then all of the passengers will be charged.

Perhaps, depending on the mood of the police officer.  If the passenger immediately claimed ownership then the cop might leave the driver alone, but if nobody said anything, then both would be arrested.  Joint ownership (no pun intended) is possible if the evidence supports it--e.g. pot found in the center console.  If the evidence shows the pot was in the passenger's luggage, along with his clothes, toiletries, etc. and it's locked and the passenger has the key, then it's possible the judge/jury could find him not guilty.  Ultimately if the state can prove an affirmative link from the driver to the pot, then he can be found guilty.

  5. both would be arrested and it would be sorted out later.  Ultimately they would both be charged, and the charges against the driver would be dismissed..../

  6. Thats kinda tricky i don't think you would get into any trouble but just in case don't act guilty in any way.
