If my Dad is a New York resident but i stay with my mom can I still be considered a New York resident?

I want to attend Brooklyn College and want to see if im eligible for In state tuition

  1. According to the Brooklyn College website,

    "To be classified as a New York State resident, an applicant must be a citizen or permanent resident of the United States and must have resided in the state of New York for the twelve-month period preceding the first day of classes of the term in which the applicant enrolls."

    So legally, it matters where you live, not where your parents live.

    Fall classes begin on August 27, 2008. This means that you had to have lived in the state of New York continuously since August 27, 2007 to be eligible for in-state tuition. If you don't meet this requirement, the earliest you can apply for in-state tuition is for classes that begin in the fall of 2009. But you have to begin living in New York state now.

    After reading Found-1's comments, I realized I posted information for graduate students. So I searched through the Brooklyn College web site again and found a second link that applies to undergraduate students. I posted it below the first link below.

    The second link states:

    "To be classified as a New York State resident, an applicant must be a citizen or permanent resident of the United States and must have resided in the state of New York for the twelve-month period preceding the first day of classes of the term in which the applicant enrolls."

    Comparing my two quotes, it appears that the residency requirements are the same for undergraduate students and graduate students.

    k**e Found-1 suggests, "double check". So contact the school directly to find out about special circumstances such as when you are a dependent and live with a divorced parent. They might allow exceptions.

Poor Horatio is quoting the residency requirments from the "graduate student" page.  Often states make different requirements for those who are under the age of majority (21 or 18).  Be sure you double check his answer... some states will allow residency  when a kids parents are divorced and one parent resides in the state but the other does not,
