Question:

If my car was totaled in rear end?

what would you estimate i would get back if my car had been rear ended and was totaled. the guy tried to flee the scene three times. he would have ran if witness hadnt blocked him in. there were three of us in the car. mainly back and neck pains but all had gone to hospital from scene, gone thru pt. have lawyer, so do realize they take their cut.

any idea on an estimate of how much i may get?

  1. If you have an OLD car, it would be next to nothing.  If you have a very new car, then it would be closer to the price you paid.

    You didn't mention what kind of car you had that was totaled.

    One more thing, when a car is totaled, it is TOTALLY damaged not just the rear end.

    As for the rest, the hospital bills are paid directly to the hospital.  

    As for pain and suffering, you need to have a loss of limb, loss of bodily function, broken bone, loss of work (like 90 days), etc. to file a law suit for pain and suffering.  Go see a lawyer for the specifics.

    The actual dollar amount depends on the actual pain and suffering.  If you were horribly disfigured that would be more than, a little fracture.

  2. Depends on what state you live in, and what your medical bills were, and what the actual injuries are.  It doesn't sound serious, you might not get anything at all, depending on if you're in a no fault state.
