If my husband serves me with divorce papers on the grounds of irreconsilable differences, ?

do i have to give him a divorce? how can i stop him.? in the papers its got where i agree to all this junk and i don't ! i dont even want one! so what do i do? i dont have to grant him a divorce

  1. You need to get an attorney. The divorce will happen but you need to make it happen on some of your terms too and not just his.

If he doesn't want to be with you anymore, why would you fight it?  Get in touch with an attorney, preferably a bulldog who will get you what you deserve.  If it took you by surprise, your attorney will probably be able to dig up some dirt on him.  His irreconcilable differences could be a girl-friend on the side.  Protect yourself girl......

  3. It doesn't matter what you want, it only takes one of the partners in order to get a divorce.

    Honey, he clearly doesn't want you anymore, why are you trying to keep him? Sign the papers and move on. I was in your position about 5 years ago (24 yrs married). I can tell you that I am a thousand times happier now, and I married a far FAR better man.

  4. No you don't. In order to get a divorce on irreconsilable differences you have to agree on the terms and you can contest it. I would probly go ahead and find an attorney for youself so you can get the things and grounds you want.  

  5. you don't have to grant him one, but you better prepare for a court battle and to shell out the bucks for a lawyer, and it still won't stop him from getting the divorce. It only helps possibly get your share from the marriage.

  6. no you dont, i would get someone to fight this for you, get what is yours.  then sign the papers, no point hanging on to him, he does not want it mrs! you will meet someone else im sure of it.

Get a solicitor, pay attention very carefully to what is being agreed but let your 'husband' do all the work for the actual divorce then its in writing that HE wanted it from you.  You can't stop it but you can be a little happier with the knowledge that its clear HE instigated and carried it through.  Also, in the long run you will be happier.  You don't realise it now but TRUST me you WILL be happier - even when you don't think it possible. :-)

I think in most states you can ask the judge to order counseling before the divorce...you do need an attorney however if you don't have the money there are many states that have free legal help you can look into that also...as for staying with someone who does not love you that can be a bad thing......but if you still think there is something then see if you can get the counseling first...good luck

  9. That usually means the wife quit putting out if the husband files on those ground and yes the judge will give him the divorce on those ground when you said i do you entered in to a contract to be his s*x kitten when and where ever he wanted, sorry i had to be honest with you.

  11. Rather you want a divorce or not - it is not up to you. The courts will eventually honor his request...

    Why would you even want someone who does not want you? Life is too short to live this way.

All you can really do is slow it up.  Why would you want to be married to someone that doesn't want to be married to you?  I think you need to be an adult about it and talk to him.  Its obvious that he feels there are some major issues.  Sit down and figure out whats going on and then work through it maturely.

  13. It doesn't take both parties agreeing to get a divorce.  Only one has to want it, file the papers, go through the steps, and then the courts will award the divorce.

  14. Maybe you should contact a lawyer. BUT my question to you is ...if he is not intrested in the marriage anymore why would you want to stay in it?  I understand that you still love him. but you can't love someone that will not return the same feelings. Love, marriage, trust, and friendship should be like a 50/50 thing.

    You can't force someone to stay in a marriage is what seems to be the bottom line and it could be that a divorce might be the best thing for you. But whatever you chose to do I wish you the best.

  18. Uuuuuh........  it takes 2 to marry, only 1 to divorce.  You can't stop it!  Anyway, why do you want to keep someone that doesn't want you?

Why would you want to stay with someone who WANTS to divorce you?  My ex didn't want to sign the papers and in the end he did.  He didn't want the divorce but I did.  And my lawyer said I would get it regardless if he didn't want it.  Call a divorce lawyer and you do not have to agree with what's in the paperwork that's why you call a lawyer and tell them what you want changed in the papers.
