If my landlord at my apartment let a tenant break the lease before,do I have the right to break the lease too?

I need to move out for a very serious family emergency but the landlord won't let me break the lease. He mentioned in our first conversation that he let one of his tenants break their lease before but it ended badly for him (the landlord). In our second conversation during one of his rambles about the severity of contracts he said "if I were to let someone break a lease then everyone would want to break their lease." He went on to say something about being legally bound to let people break their lease because if he lets one person do it then he can't just do it for that one person because of legal issues. He probably forgot that he told me he let someone break their lease before. Can I use that against him to break my lease?

  1. No. A lease is a legally binding contractual agreement. You signed it. Nobody *has to* let you break it for any reason.


  2. Surely you have a housing authority in your City.. Also a state authority.... I suggest you call them and see what they have to say.... If you are totally honest with your landlord he may help you.  Remember  ----- U DID SIGN THE LEASE !!!

  3. No you cannot.  He has indicated that he will not break leases anymore for anyone.  That includes you and his other tenants.  You can still move out for your 'serious family emergency', but that doesn't mean you get to break your lease.

  4. Your lease is a contract between you and your landlord. The contract between your landlord and someone else doesn't matter. If your landlord didn't choose to get everything out of the other lease, that was his decision at the time.

  5. Of course not.  Two wrongs don't make a right.

    You think he should never again be bound to a legal contract because he did one person a favor once?
