Question:

If my mother married an american when i was 7 does that automatically make me a citizen? i'm now 24.?

i was 15 when they got married and i never took the test. but i have heard that i don't need to take the test to get my citizenship is this true? i now live in the uk and was wondering if i could take care of this at the embassy here.

  1. If you were born in the U.S., I would say you would be a citizen.  But unless your stepfather adopted you and made citizenship provisions for you, you're not a citizen of the US.  I would say go to the embassy with whatever documentation you have and start the process.

If your mother married an american citizen AND she became a citizen too when you were still a minor, under 18,then if you are in U.K, she has to petition you first to be a legal resident when you reach the U.S, then she could get you a certificate of citizenship  or U.S passport based on the CHILD act 2000,that's IF your still under 18,But since your over 18 now, you have to go through a regular processing of petitioning or sponsoring you by your mother and wait for a few years for the application to be approved and stay in U.S for 5 years in order for you to acquire your citizenship

  4. well, your basic facts here disagree. First you say you were 7 and then 15 when they married. Did you ever get a green card? doesn't sound like it. and, it doesn't sound like you're eligible for US citizenship based on what you've said here. On the other hand, if you really want to be an American and live in the US, maybe you should talk to your mother and stepfather about filing an immigrant visa petition for you, assuming they live in the US and not in the UK as well.  Either one could file for you under US immigration law.

No.  Nothing is ever automatic with immigration.  You're mother may be able to petition for you, as her relative, to become a permanent resident and eventually a citizen but that would depend on her immigration status.  Go to the immigration web site www.uscis.gov.  That has a lot of information on who can apply for residency and how to do it.
