Question:

If my wife is approved for a K3 visa, will it be sent to her home in Singapore, or to me in the US?

We obviously have a way to go before this process is completed, but would like to shorten the time that we spend apart. In a few months, she would like to apply for a tourist visa and possibly stay in the US, contingent on approval of the K3 visa.

  1. You appear to have things backwards. If the purpose of her trip to the U.S. is to live with you, she does not qualify for a B-2 visa, but she would qualify for a K-3 visa. That's what the K-3 is for, to reunite separated couples.

    If you have already filed an I-130, you can file an I-129 to accord your wife the status of a K-3. Of course, the K-3 visa is not mailed to someone's home. It is a document placed onto a page of a passport.

    If you submit an I-129 to CIS, and it is approved, your wife can apply for a K-3 visa in her home country and come to the U.S. with the visa to apply for admission. If she is admitted, she can join you and apply for permanent residence inside the U.S.


  2. If you have a K3 visa pending the chances of getting a tourist visa is slim (she is considered a immigration risk). YOU can go visit her if that is OK with her government. Good Luck!
