  1. You have to check with law in your state.  

    Normally, law says a husband/wife is liable for each other's debts, when married.  I don't think what name she used is relevant.

  3. Not necessarily.

    I have my own credit cards, in my married last name.

    I applied for and received those cards, using my income, only.

    My husband is not the co-owner of those cards.

    My husband has never charged anything on them and never will.

    He is not legally responsible for the debt incurred on my cards, as long as he never uses them.

    Even if I die, he is not responsible for the debts/charges made on my cards. The credit card companys will write off the balance, after he provides proof (via a certified death certificate) of my death.

    A little trick I learned from a friend, who out-lived 2 husbands, never used their cards & was not the co-owner. She didn't have to pay a single penny on close to $25,000.00 in credit card debit, between the two dearly departed.

    This question would probably get a better response over in the legal section.  We generally deal with the dead here, and they don't have much debt.
