If only the wife signed the rental lease, do I send the 3 day pay or quit notice to her and the husband?

Or just her? This is in the state of California. Also, do I have to sign the 3 day pay or quit notice or will a typed letter suffice?

  2. You should include the names of all the people you know of to be living in the unit and who ever signed the lease.

    You have to sign the 3 day notice quit.

    The trick with a 3 day notices is proof of service; when you as the owner sign the proof of service, that you served the tenant, if the evicton goes to court the tenant can 'lie' and say they were never served, stalling the eviction for anther couple of months.

    The issue is your word against the tenants, not that either party is incabable of lying for profit.

    Eviction services are good because they provide process servers that serve the 3 day notice, who are usually off duty police officers so it is almost impossible for a tenant to challenge the word of a off duty cop.

    Depends on how bad you think the situation is going to get on wether or not it’s worth getting an Eviction service, they do cost.

  3. Since only one signed the lease, send it to her.  But be sure to list the husband as well as "john does" so that it covers everyone living there.

  4. You need to sign it and every adult has to be named.    Evicting the wife does not evict the husband.    If he has been living there it is his legal residence, lease or no lease.
