If parent is co-signer, can they put car on Bankruptcy?

my mom co-signed my auto loan. the car stopped working 5 months ago and i've still been making monthly payments on a freaking car that will cost more to fix than what it's worth. my mom is about to file bankruptcy. Will she be able to put this on it?

  1. Although I'm not a lawyer, but worked in legal for 25 years, here's what I know . . .

    It will depend on:

    1.  The laws in general in the state you live in,

    2.  The terms of the loan for the car,

    3.  The bankruptcy laws in the state you live in.

    Have you check about Lemon Laws for your car?  Google that terms and see what you can find out.  You might be able to return the car to the dealer (if you bought from a dealer).


  2. In general, if your mom files for bankruptcy protection, only she gets relief from the debt.  You are still 100% on the hook.

    In any case, if your mom has an attorney, have the attorney look into this specific situation for you.
