If reversing into a space and somebody drives theirs car into the back of your car, whose fault is it?

As mentioned above. Reversing back when all of a sudden another car hits the car on the side. There was no room even for a mini to get in the space. Is there a rule that its the driver's fault reversing into the space that is in the wrong, or the other driver. A witness saw what happened.

  1. Accidents in parking situations, where both cars are moving,  are generally considered 50/50 or each one equally liable. At that's the case in all the places where I have lived. Check with your local law enforcement or your insurance agent to find out the rulings in your area.

In this age of modern technology when law enforcement officials, lawyers and everyone else and their uncle is able to use online information as a resource or evidence, it's best not to post questions like this online.  When you have an accident, the best thing you can do is remain in or around your vehicle and keep your mouth shut.  Don't admit fault, don't apologize...You then call the cops and your insurance company.  It's their job to decide whose fault the accident was.

    In general, while reversing, if you hit something it is your fault.

  5. I've always understood the driving code to mean anyone who hits a car in the back is wrong. If someone in front of you is attempting to park, courtesy says stop and give that person a chance to park, even if you think that space is too small for his car to fit. Give them every opportunity to park, then drive around them when it's safe.

  6. yes your to drive in a parking spaces ... not back into them and any time your Reversing and you hit something your at fault.. so that makes you wrong twice
