  1. it depends where you are.

in australia, if someone is working on your property, then they should have their own workers compensation insurance to cover them for injuries whilst they are doing their job.

if however, they state that the reason for their injuries is due to YOUR negligence (for whatever reason) then they (or their workers comp insurer) can attempt to claim from the public liability portion of your home building insurance.

  2. If he's working on your property then he should have his own insurance against injury at work.

Why should your insurance pay, with presumably higher premiums for you next year?

  3. Was the person on the ladder hired by you?

  4. He should be covered under your Medical Payments up to the policy limit (assuming he is not a resident of your household). He would also be covered under any workers compensation provided by his employer if he is working on your property as part of his job.

As long as he brings his own ladder and sets it up and you don't do anything to cause him to fall- you should not be responsible for his injury.  Now, if it's your ladder and there is something faulty with the ladder that causes the injury - he may be able to come after you.  Just make sure he brings his own equipment.

If the workman gets hurt - call your homeowners company right away and file a claim. They will investigate what happened. If they determine that you are not responsible for his injury and he sues you - your homeowners company will hire a lawyer to defend you.

  5. If they are not a member of your household and you have med pay on your policy they will have coverage for medical expenses up to your med pay limit.

If their medical expenses are more than your med pay limit then they would have to prove negligence in order for your liability to kick in.
