If someone gives birth to his/her kid in abroad but parents only have the tourist visa when she give birth to?

  1. Parents will not get PR. Child will get citizenship of country of parents. If PR is allow in this, all pregnent ladies will visit US for delivery.


  2. Today it is more common for a child's citizenship to be determined by the country they were born in AND what status their parents hold in that country at the time of the child's birth. For example Australia and UK both have laws stating that a child born in their respective countries will automatically gain citizenship if the parents hold permanent residence or citizenship themselves.

    US and Canada both allow for citizenship via birth but there is no provision for the parents to be able to stay in the country.

    I believe that Ireland was one of the last countries to have citizenship via birth and allow for permanent residence for the parents but because they were part of the EU they had a lot of refugees and foreigners abusing it so they changed the law (I believe that's how they got a failed Nigerian aslyum seeker as a Irish citizen and a major now). They changed the law in 2004/5.

    Usually if you give birth in a country other than the one you hold citizenship in you get the state the child was born in in's birth certificate and then you have to apply for citizenship with your country's nationality.

    The anchor baby is becoming extinct.

  3. The child may get citizenship if the country accepts jus soli or birthright citizenship. The parents will not get permanent residency if ever. They will be allowed to bring their child home. The child may come back to the birth country once he/she is of legal age and may petition them. But that will be a long time.

  4. It obviously depends on the country's rules, but usually neither the child nor the parents would be granted residency, they would need to return once safe to do so to the country of origin.

  5. Laws vary, but often the child will be granted citizenship. Many foreigners (particularly Mexicans) once used this loophole to gain U.S. citizenship for their children, but I believe it is no longer possible in the U.S.

    Just because one's children are citizens does not mean that the parents will be granted residency rights or a green card. There have been a number of well-publicized cases where  the parents of U.S. citizens were deported; in fact, it is so common that it has become a real crisis.
