Question:

If someone hit me and I didn't report it, can they come back later and claim it was my fault?

When I stopped at a red light, a car hit me from behind. It was so minor that it didn't cause any damage to my car or to theirs. It was like the accident never happend. I had just gotten some bad news and was already very shaken up so out of my own stupidity, I didn't get any info from them and they didn't get any from me. However, my tag number was visible to them. We decided not to report it and just went on our merry little way. I am so worried now because I realize that they can call the police and say that it was a hit and run and it would be my word against theirs. Should I just hope that nothing comes of it and just let it go or should I suck it up and call the police anyway, despite that I dont' have any information about the other driver at all?

Don't worry if the other driver does call the police and they find out that he/she is lying they will call her on false pretence and you will win the lawsuit  also if your worried that its his/hers word against yours then you shouldn't worry because if he/she does file a lawsuit then they wil check the traffic cameras.

  2. Wouldn't worry about it. No visible damage to either car? The hit was to your rear? They'd have NO leg to stand on. They could name anyone's plate if they wanted to claim hit and run with no damage. No one's gonna buy it. You are not required to file a police report for something like that to begin with, at least not where I live. I was involved in a three car no injury accident months ago, with *lots* of damage to all cars, and the police asked if we wanted to file a report or handle it ourselves. I was shocked; I thought it would be automatic. In that case, we obviously filed.  I know you're shaken up right now, but rest easy and forget it.

    be in some hot water.  but I think this only

    applies to an accident that has more than minor

    damage.

  4. Don't worry. Why would this stranger go out his way to get you into trouble and increase his insurance.

    But next time get his insurance information (or at least get his phone number).  If he reports you, you could show that you swapped info and both decided NOT to report.

  5. Read the news, it happens everyday the same situation that's why its it always best to get a police report.

    The last one was were the guilty party reported that the innocent party did a hit and run and guess who got the raw end of the deal until a witness stepped up.

    Report it NOW for your protection.
