If someone holds a cell phone to your ear while you are driving, is it illegal?

Ever since the new law that went in affect July 1, all cell phone users are required to switch to hands free way to talk on the cell phone while they are driving. But does that law mean that a passenger can't hold the phone to your ear while you drive?

  1. best way to use cell phone while driving car use bluetooth not hands free cuz if cop see's hands free he will give u ticket use the bluetooth i think thats safe.good luck

  3. I think that you may be misunderstanding the total intent of the law.  While I doubt that it is illegal for someone to hold the phone up to your ear, the idea is really to try and discourage talking while driving.

    Have you ever seen someone in a restaurant when they get a call on the cell?  They stop what they are doing, ignore anyone they are with and give their total attention to the caller.  It's that same mindset that makes talking and driving such a dangerous combination.  I don't even like carrying on a conversation with my wife if it requires any deep thinking.

    The reason is because driving is my number one priority.  Driving safely so that I don't hurt myself or anyone else.  Unfortunately, most people don't feel that way.  They think that they can drive and do a myriad of other activities at the same time..apply make-up, check some papers for something, look at a map, or talk on the phone.

    That's why there are more and more accidents these days.  You can get away with those activities for awhile, but eventually they are going to cause something bad to happen.  How would you like it if the pilot of your flight was being distracted with watching a p**n flick or playing cards with the co-pilot during take-off or landing?  You wouldn't feel very safe would you?

    The really bad part about this is that a lot of people on the road aren't very good drivers to begin with, but now you want to put a cell phone in their hands?  Think about it.  Don't ask questions on how to circumvent the law so that you can still talk and drive.  Take steps to make yourself a better driver and tell the caller that either you will pull over so that you can take their call, or you will call them when you get to your destination.
