If someone is arrested for "assault with occasional ABH" whats likely to happen to them?

They have been bailed and given a date to report back to the police station. Also taking into consideration its the persons first arrest and have never been in trouble with the police before?

  1. The offence is "assault occassioning ABH".Released on Police bail usually means the cops are not sure who (or whether ) to charge yet.You are in their hands.

Without knowing the specifics of the incident, its hard to say for sure, but most likely the prosecutor will offer a plea bargain to a lesser charge, the terms of which will vary based on the amount of damage (the fact that bail was given is a good indicator of this).  This is a fairly common process for first offenders.  Note that agreeing to the plea may stillr esult in a criminal record, depending on the final charge(s)

    If the accused refuses the plea bargain, the case will go to court.  

    Either way, hiring a local lawyer with knowledge of the court system is highly recommended.

His bail maybe cancelled and no further action taken in the case or he may be charged with an offence when he returns on bail. Im assuming he denined the allegation and so wont be eligable to recieve a police caution.

    If charged and found guilty the sentance at court will depend of the level of injuries caused and how he caused them etc?

    What are the facts of the case?  The charge is one thing, but it has to fit the elements of the offense or there is no case.

    Is he being prosecutued by felony or misdemeanor (don't go by the arrest charges - the police have their standards for determining what charge to use, the prosecutors another).
