If someone is deported from a country how long before that person can enter the country again (south africa)?

my husband was deported about a month an a half ago, he had been there for 3 years prior. my lawyer informed me that according to immigration law. he can only enter after a year an this is only if his application for rehabilition is successful, he believes it would be because whilst in SA my husband was a law abiding citizen who worked and paid his taxes. he was deported because his documents were not in order. he had an ID document an passport which was issued by government so the docs were real. but my lawyer says that the manner in which he got his docs was why he got deported. i basically would just like to know what the proper an legal procedures for entry would be. would really appreciate it

  1. Well that depends on what he was charged with when he was deported.  

    If you look on the order from the Immigrating court it will show you how long he is supposed to be deported for.  The min time is usually 5 years.  If he was granted a vol departure then he wasn't officially deported and can reapply for entry,

    If you are an American citizen it helps.  Also if your husband was convicted of a felony then he will never be able to come back.  Talk to your lawyer he can help.  You can also look up the Immigration laws on line or contact CIS www.cis.gov and ask questions.
