  1. yes they can.  It happens all the time.  The passenger only has a case if the passenger was following all traffic laws and wearing a seatbelt.  

    I had a friend that got in an accident where they hit a lightpole, and the friend sued the friend and won.


  2. Certainly!    They can sue the driver of the vehicle they were in,  and anyone else their lawyer can think of.      This is one reason it is not safe to give rides to folks you don't know.

  3. Absolutely!! But it all comes down to whether or not the passenger was being responsible as well. Like, were they wearing a seatbelt? Were they a minor or adult? Air bags? Was there more than one vehicle involved or single car accident? Was the driver at fault or was it something someone else did? There are so many levels with this without knowing some of the details it's hard to say...

  5. The passenger can sue the driver of the car they were in, and the driver of any other vehicle involved in the accident.

  6. yes. but who is the real question here isn't it? If it was the driver of the car they were riding in, than they would sue the driver's insurance...driver doesn't have,than the driver, and same would go if other party was at fault
