If someone is married an EU citzen and he/she has her/his green card?

if she/he is married to an EU citezen for 2 year and he/she has the greencard forever and he/she has really married him but its not working out it wasnt a marridge for something and she/he want a divorce but he/she doesnt wont to loose the greencard forever ???

can they take the greencard out because they got a divorce.plus she/he has 3 children.they have it also.plus living with her/him

  1. when u marry EU citzen, u can apply for ur papers and u normally get them. u get in europe 2 years and the u can renew for 2 years and then u get the green card or ... about the divore I have no idea . But once u are there and u divorce with kids, there is a way or a law that keeps u next to ur kids but have to pay for the kids

  3. It is true that "Permanent" Residency is not permanent - a Green Card holder (Permanent Resident) can be expelled from the US for antisocial behavior and definitley for any felony conviction.

    In the above case, it appears that the foreign spouse has acted in good faith and that the marriage has broken down through a "no fault" situation. If this is the case, and the original marriage was genuine, then is is likely that the CIS will let the Permanent resident remain in the US.
