If someone is rear ended who does the police officer talk to first normaly?

Can he just not take your statement if he believes the person that hit the back of your car is right?

Does he normally talk to the person that got hit first?

If your rear ended cause guy behind you wasn't paying attention and your say stopped at a traffic light.

This all happened to me.

  1. We don't talk to people at collision scenes in any particular order, per se.

    No, ordinarily we would take the statements of all drivers involved in a collision.  I'm going to make a wild guess and suggest that your statement was taken and you don't realize it (if you're hit from behind, normally about all you can say is, "I was stopped here and that guy ran into me"...it's not exactly a whodunit in a rear-end collision, you know).

    Yes.  You were ignored the whole time and it was stupid.  I get it.

    I cannot imagine what photgraphic evidence you could have that proves someone ran into you (versus you backing into someone else, for example), but if you have it you sure want to hang onto it.  Once the report has been filed by the officer's agency, make an appointment with someone who reviews collisions in that agency and present your proof.  Ask to have the fault determination reviewed again in light of your photographic evidence.


  2. The officer doesn't know who was hit first when he initially gets there.  If there were witnesses, that's his/her best chance of getting the whole story.  You say you have photo evidence--who took the pics?  You?  That would be after the fact and is only good for damages to your car, not who was at fault.

  3. See if everyone is o.k., then make a quick check to see if either driver appears to be under the influence,then speak with the driver that hit the car in front of them and get license and insurance,then speak to the driver who was hit and get license and insurance,then issue citation if needed,and then call for wrecker if needed.That's it.
