does the person who hit them get charged with murder?

even though they were innocently driving the proper speed limit and there was no way for them to stop?

how would this situation be handeled?

  1. In this case, no criminal case will be brought against the driver in question.

    The person's family can try to bring a civil suit, and the driver's insurance company may offer them something to get rid of them, since going to court cost $$$, even if they are quite certain they'll win.

    The person ran into the freeway and was hit.

  5. As an accident. Indecently, your car would be give a  through check by police and if something is found amiss, summons will be issued.

    In most states, the driver of a vehicle needs to be in complete control of his automobile and the surrounding environment.  We had a situation like this happen when a kid chased a ball into a street and got hit by a car.  Because the driver should have been paying attention by driving safely, they should have avoided the kid, including coming to a complete stop.  They were charged with reckless endangerment and assault.

    The same applies on a freeway.  You should be alert and able to avoid or stop if a person is physically walking on a freeway.  If you hit them, even if they throw themselves onto your car, it is your fault.  If you had "No way to avoid them" you were driving in an unsafe manner or not paying attention to what was going on around you, like not seeing the guy in the road.
