If someone swings at me at my house and I beat them up am I at fault?

My sisters fiance has been threatening my pregnant sister so yesterday he comes to my house angry yelling and screaming at her etc.. says he is going to kill her etc.. so I go upstairs and he swings at me so I choked him out and restrained him and then asked him to leave. After I get off of him he comes up behind me and cheap shots me so I caught him with a right hook and then threw his face through the wall and one more time I restrained him and asked him to leave, he attempted to choke me I threw him off of me and his fat out of shape behind sat down out of breathe. Then he would not leave he went outside grabbed baseball bat started screaming at the top of his lungs he was going to kill everyone my neighboors heard everything am I at fault can i have charges pressed against me??? I am getting ready for nursing school I cant afford a charge right now?? I did the right thing correct?? Now he is saying I swung at him first and my sisters immature *** Is blinded by there love and she says she didn't see anything when she was right there the whole time?? I am 19 this guy is 25 I am 155 lbs he is 270 why would I swing at this guy first??? I think he is more or less ashamed and embarrassed that someone as small as me who he thought he could take beat the **** out of him I took it easy on him and was calm the whole time asking him to leave even when I was on top of him with my knee on his throat I calmly stated that I was going to unrestrain him if he would leave... Am I going to get introuble am I at fault?? I also had a friend of mine here when this guys swung at me first is that going to help if he lies and said i swung first?? does it even matter if I were to have swung first I didn't know if this guy was going to seriously hurt my sister? Just so if they lie I wont even have to try and fight it...

if it happened in your home..its self defense you should be fine :)

In my opinion you had every right to defend yourself and your sister. From what I know because you were in your home and asked him to leave and he refused you have the right to use physical force to remove him from your property. Having your neighbour and any other witnesses give you a signed written statement as to what treats he uttered will definitely support you. Don't worry about the judge if it goes that far He/She will see right through your sister being blinded by love. Just make sure you have documentation supporting uttered threats.

something similar happened to me..

i was dating this chicks ex boyfriend..

and i was at work [fast food place] and i was outside when she walk up screaming and i saw her fist swinging towardsme, so i grabbed it and pulled her down..hit her.. then ran.. cuz im a fast runner..

then she tried to get me fired for assaulting her when i was just acting out of self defense..and im this tiny 18 year old and weigh 112lbs and shes really big.

ANYWAYS..

its not ur fault.. he cant press charges against u.. i went thru this.. if he wud have attacked you, walked away, and THEN you run up to him and beat him up then he can..

but you sais you beat him up WHILE he was hitting you, so its an act of self defense. and you can press charges against him.

if you see him walking up screaming call the police right away and lock urself in a room, or just stay away from him until the police comes, if they find him threatening you or anyone else they can have him arrested!
