Question:

If the driver in the vehicle (owned by his father) that hit me was not insured but his father was...?

a driver went into the wrong lane and hit me head on, i just got the police report and i am trying to get in touch with him but no answer yet. The driver was a 17 year old boy driving his father's car. Here is my question though...what would happen if the 17 year old boy wasn't on his father's insurance policy? will i be still eligible for compensation.?

  1. If the boy had permission to use the car I would say yes. The owner is responsable for the action of whoever he loans the car to.Good Luck


  2. If all else fails you can always sue the father. As the owner of the vehicle he is responsible for the vehicle.

  3. It depends on where you live- in Florida, we are a no fault insurance state- your own insurance company will pay and collect from him- or not if he isn't covered.

  4. Likely not.    If they were committing insurance fraud by not listing the youthful operator, that gets their insurer off the hook.

    But you can still sue the driver, AND the owner of the car, for damages.  

    Or, you can just go through YOUR insurance company, and let them worry about it.

  5. Insurance goes with cars, not with drivers.  If the 17 year old was driving with permission, (didn't steal the car), it's covered.  Just report it to your insurance company and follow their suggestions.

  6. it depends on the insurance company. If hes not you will have to sue when hes 18 and hope he pays.
