If the father signed the birth certificate can he deny paternity?

I am 9 months pregnant with my second child. Both my children are by the same person. He got arrested and put into the county jail. The lady from the hospital gave me a form he could fill out so that the birth certificate wouldn't be held up. I did what they told me to do and he willingly signed it. I got a phone call today from his parents saying he wants me to rip up the paper so he can get a DNA test all because i don't want to be with him anymore. Because the paper was a legal document and there are witnesses that had to sign as well. Is there anyway he can stop me from giving the paper in or is it a binding form?

  1. It's a binding form. He can still ask for a paternity test (depending on what state you're from), but it is actually a legal document when it is turned in, so he is legally responsible for the child.


  2. If he already signed it and it has been witnessed and is in your possession, use it.  And when he gets out he can pay for a paternity test and court.

    And when his parents call, let the machine or the voice mail get it and same goes for him.  Just worry about you and your kid.  Because no loving grandparent would even be so bold as to get in the middle of this.  Especially with you being 9 months pregnant.  Nor would he.  They are all more worried about money than you or the kid.  Sorry to say it but you got a momma's boy there.  His parents are continuing to coddle him by getting in your business.

    You worry about you and your kids and let him worry about him.  And until he gets a job and pays support for a year, don't be crawling in bed with him and making baby number three without being fully aware that your kids are in for a part time dad who has no sense of responsibility.  And they don't deserve that.

  3. A birth certificate has no legal significance.  If he wants to deny paternity, he can do so.  If you ask for support, the court will order a paternity test to see if he has to pay or not.

He can have a paternity test that he will have to pay for he will have to pay maintanice until he can prove otherwise he is not father and will continue to have to once it is confirmed he is the father. By signing the birth certificate he has a parantal responsibility for the child.

    He does have the option to dispute it in most states. Normally there is a time limit for his dispute: anywhere from 30 days to 2 years depending on state and which case law they go by (many places have conflicting laws).
