If two cars in opposite directions are making left turns and a third car pass on the right hand side?

You are traveling behind a car on a two lane road and the car in front of you signasl for a left turn at the same time a car in the opposite direction is turning left. You attempt to pass the car in front of you on the right, the car in the opposite direction turns left and you both collide. Who is at fault? Who has the right of way? Where is the proof to cite this?

  1. Is there only one lane going in each direction?

    If so, you would be at fault, because you did not have a legal lane to go around the person ahead of you.

    If there were two lanes going in your direction, and you moved to the right-hand lane to go around the car ahead of you, it would have been the other person's fault, because they failed to yeild to oncoming traffic.


  2. In most places it is illegal to pass anyone within 50 ft of an intersection (30 meters). If you see a solid line before an intersection, then you shouldn't pass. The scenario you cited above explains why you shouldn't pass!

    Check with your local Highway Traffic code and/or the local authorities, your local Driving Examiner or local Driving School.
