If u r arrested on suspicion but were later released without charge will this show up on a background check?

my other half has just got a new job and we are concerned that his arrest on suspicion will show up on a background check he was later released without charge and bail was cancelled what can a person see on his background check please help xx

  1. You just answered your own question "later released without charge" So I don't think so.


  2. No, it won't and illegal to ask about if you have ever been arrested or charged with something. It's legal however fir them to ask if you have ever been *Convicted* of something.

    *Note: I'm oversimplifying employment law on this issue. In your case however, to the best of my knowledge, no, you do not have to put it down.

  3. It used to be if a person had an arrest, it would have mattered. Now it has been changed to "Convicted", which makes background checks more equitable.  However, if his new company finds out about the arrest and questions him re it, he should be truthful and answer all questions.  Police can, and do, make mistakes during an arrest.  When the cause of the arrest is investigated, it generally proves involvement or not.

  4. It should not show up on an employment background check as long as the company is conducting a proper check.  If the company is using a database, then the arrest might be included in the data purchased.  This is not an acceptable method of background screening, but many companies do not understand that.  Arrests are not permitted as a determining factor for employment.

  5. If he was never formally charged, by a court then it will not be part of a criminal record.  Many background agenicies use the interent so type in your other half's name and town and see if the paper published the arrest that will show up.  What is best is if that application asks if you have ever been charged with a misdemeanor or felony then say no becasue you were not chared.  If it says arrested you proabably better fill it out and explain why they dropped the charges, they will never really know why the charges were droped so explain it in a way that looks ok.

  6. Yes.  It will show exactly what you stated.

    Arrested, released W/O charging.   Unless the arrest report just happened to disappear.
